We thank you and appreciate your purchase with us. Please read the policy, conditions and process carefully as they will give you important information and guidelines about your rights and obligations as our customer, concerning any you purchase through our website unless specifically stated otherwise on our product pages or readers offer advertisements. If due to any reason, unavoidable circumstances or beyond the limitations of the merchants the order is not shipped by the seller then the order shall be cancelled and refunded. In the event the order/product is delivered and has been cancelled for refund due to product being damaged or not in the eatable condition then within 15 minutes of delivery you must bring it to our notice by mailing us at contact@upchef.in along with the photograph which clearly substantiate your claim of damage in the product. After thoroughly accessing your claim and on being satisfied with the photographic evidence presented by you to substantiate the same , the refund is processed by us.

We reserve the right shipping a product to you. We can refuse an order if we do not want to serve you, without any legal repercussions.

1. INCORRECT OR DAMAGED GOODS

In case a User has received a wrong product, user has to intimate within 15 minutes of the User receiving it, the buyer will get the same product and same quantity within 24 hours. The only mode of intimating the request can be through e-mail sent to contact@upchef.in .The mail communication should clearly state the complaints with the product and should have photographs to support the claims. The return request shall be accepted by the Company only after the complaint has been verified and the Company and the vendor is satisfied with the photographs produced as proofs. If the fault has occurred due to the User’s negligence he shall be charged for the same.

2. CANCELLATION

As a User, you may cancel your order at any time until the order has been processed by the Company, after being placed. In such a case we will refund payments, if any, already made by you under the relevant order. Any return or refund will be in accordance with our return & refund policy, which has been specified on the website.

The Company at its sole discretion may cancel any order(s):

a.if it suspects a User has undertaken a fraudulent transaction, or

b. if it suspects a User has undertaken a transaction which is not in accordance with the Terms of Use, or

c. in case of unavailability of a product, or

d. For any reason outside the control of the Company including causes for delivery related logistical difficulties.

e.if the Company does not want to do business with the User

Further, while all measures are taken to ensure accuracy of product specifications and pricing, the details of a product as reflected on the Website may be inaccurate due to technical issues, typographical errors or incorrect product information provided on the Platform by a Vendor and in such an event you shall be notified as soon as such error comes to the notice of the Company. In such event, the Company reserves the right to cancel your order and refund any money that may have been paid by you towards purchase of such products.

Customer may choose to cancel the Order only within five (5) minutes of the order being placed on UpChef (“Cut-off Period”). However, subject to the Customer’s previous cancellation history, UpChef reserves the right to deny any refund to the Customer, pursuant to a cancellation initiated by the Customer, even if the same is within the five (5) minutes, followed by the suspension of account, as may be necessary, which shall be in the sole discretion of UpChef.

After the period of five (5) minutes, i.e. the Cut-off Period, UpChef will not accept any cancellation. If the Customer cancels his/her Order after five (5) minute of placing it, UpChef shall have a right to collect a penalty of hundred percent. (100%) of the order amount for breach of contract terms, as a compensation, for the damages suffered by UpChef.

In the event the cancellation is made in time, i.e. before the Cut-off Period and thereafter the Chef has accepted your cancellation, we will refund or re-credit your debit or credit card with the full amount, including the delivery charges, if any. The processed refund shall directly be credited to the source payment mode or bank of the Customer from which the initial payment was made.

UpChef reserves the right to collect penalty equal to the order value for the orders constrained to be cancelled by UpChef for reasons not attributable to it, including but not limited to:

in the event if the address provided by the Customer is wrong;

failure to deliver the order to the Customer due to lack of information, direction or authorization from Customer at the time of delivery.

failure to contact the Customer by phone or email at the time of delivering the booked order;

We maintain a negative list of all fraudulent transactions and non-complying users, and reserve the right to deny access to such users at any time or cancel any orders placed by them in future.

3. REFUND

Refund will be issued by the Company if the product cannot be accepted by the vendor due to unavailability of the ingredients or due to some unavoidable circumstances . Refunds will be issued by the same means of payment as used for the initial transaction, in case of paid orders. You will not incur any fees as a result of such return. The refund processed by the Company could take your bank anywhere between 7 to 10 days to credit the amount.
