Home Chef (Vendor) - Terms of Use
Welcome to UpChef! These Terms and Conditions (“Terms”) govern the use of our services and the relationship between UpChef (“we,” “us,” “our”) and you as a home chef (“you,” “your”). By registering as a home chef and offering your culinary services on our platform, you agree to comply with these Terms.
- Eligibility
1.1. You must be at least 18 years old to register as a home chef.
1.2. You must comply with all local laws and regulations related to food preparation and safety.
1.3. By registering, you confirm that all information provided is accurate and up to date.
- Registration and Account
2.1. You are required to create an account by providing accurate personal and business details.
2.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
2.3. We reserve the right to suspend or terminate accounts that violate these Terms.
- Food Safety and Compliance
3.1. You must adhere to all applicable food safety standards, including proper storage, handling, and preparation of food.
3.2. You are responsible for obtaining any required permits or licenses for operating as a home chef.
3.3. You agree to allow inspections by relevant authorities and UpChef team if required.
- Menu and Pricing
4.1. You are responsible for setting your menu items and pricing.
4.2. You must ensure that all descriptions, ingredients, and allergens are accurately listed.
4.3. Changes to your menu or pricing must be updated promptly on the platform.
- Orders and Fulfillment
5.1. You agree to accept and fulfil orders in a timely and professional manner.
5.2. Any cancellation or modification to an order must comply with the cancellation policy outlined by the platform.
5.3. You are responsible for the quality, packaging, and timely delivery (if applicable) of your food items.
- Payments
6.1. Payments will be processed through the platform’s payment system. Fees may apply as per the platform’s pricing structure.
6.2. Payouts to you will be made in accordance with our payment schedule.
6.3. A 18% GST will be applied to the platform’s commission fees as per applicable laws.
6.4. A 1% TDS (Tax Deducted at Source) on your sales will be deducted and must be accounted for by you.
6.5. You are responsible for reporting and claiming TDS related to your earnings.
- Prohibited Activities
7.1. The following activities are strictly prohibited:
- Misrepresentation of your identity or services.
- Sale of illegal, unsafe, or non-compliant food items.
- Discrimination or harassment of customers or other users.
7.2. Violations of this section may result in immediate account suspension or termination.
- Platform Usage
8.1. The platform is provided "as is" without warranties of any kind.
8.2. We are not responsible for disputes between home chefs and customers but will facilitate resolution where possible.
8.3. We reserve the right to modify or discontinue the platform at any time.
- Limitation of Liability
9.1. To the extent permitted by law, UpChef is not liable for any damages arising from your use of the platform or your services as a home chef.
9.2. You agree to indemnify and hold us harmless from any claims, liabilities, or expenses arising out of your activities as a home chef.
9.3. Any disputes related to food quality, taste, or related issues are solely your responsibility as the home chef.
- Termination
10.1. You may terminate your account at any time by providing written notice.
10.2. We reserve the right to suspend or terminate your account for violations of these Terms or applicable laws.
- Amendments
11.1. We may update these Terms from time to time. Changes will be effective upon posting on the platform.
11.2. Continued use of the platform constitutes acceptance of the revised Terms.
- Governing Law
12.1. These Terms are governed by the laws of Kolkata.
12.2. Any disputes will be resolved through arbitration or in the courts of Kolkata.
By registering as a home chef on UpChef, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
